1. Acceptance of Terms
By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
2. Account Responsibilities
You are responsible for safeguarding the password used to access the service and for any activities or actions taken under your password. You agree not to disclose your password to any third party.
3. Intellectual Property
The service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of the platform and its licensors. For AI-generated images, users with an active subscription or credits hold the commercial usage rights to those images.
4. Acceptable Use Policy (AUP)
To maintain a safe, lawful, and compliant platform, you must follow the policies below when using our AI image generation service. This Acceptable Use Policy is part of the Terms of Service, and a violation of the AUP is equivalent to a violation of the Terms of Service.
Prohibited Content Categories
You may not use this service to generate, upload, use as reference, distribute, or share any of the following types of content:
- NSFW / Sexual Content: Generation or uploading of any form of adult sexual content, explicit sexual content, nudity, sexually suggestive content, or soft pornographic imagery is strictly prohibited. This service does not allow the generation of any NSFW (Not Safe For Work) content.
- Inappropriate Content Involving Minors: Generation of any sexualized, exposed, sexual, or inappropriate content involving minors (under 18) is strictly prohibited. This is an absolute zero-tolerance policy. Any such content will be immediately removed and reported to relevant law enforcement agencies.
- Violent or Gory Content: Generation of imagery depicting cruel violence, gore, self-harm, animal abuse, or terrorism is strictly prohibited.
- Illegal Content: Generation of any illegal content related to drugs, weapon manufacturing, human trafficking, money laundering, fraud, or document forgery is strictly prohibited.
- Impersonating Real People: Generating recognizable images of real people (including public figures, celebrities, and politicians) without their written authorization is strictly prohibited, especially for purposes of defamation, humiliation, or misinformation.
- Hate Speech and Discrimination: Generation of hateful, discriminatory, or demeaning content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics is strictly prohibited.
- Harassment, Intimidation, and Bullying: Generation of content intended to harass, intimidate, stalk, or cyberbully a specific individual is strictly prohibited.
- Malware and Scams: Generation of content related to malware, phishing, deceptive advertising, fake websites, or scam campaigns is strictly prohibited.
- Misinformation and Deepfakes: Generation of fake news, fabricated evidence, political deepfakes, or content that could manipulate elections or mislead the public is strictly prohibited.
- Copyright and Trademark Infringement: Generation of content containing copyrighted material from others (such as brand logos, cartoon characters, or movie/TV stills) is strictly prohibited unless you hold valid authorization.
Content Moderation
We apply automated content moderation (Content Moderation API) to all user-submitted prompts and uploaded images. The system will block and reject any request identified as a violation. Moderation outcomes may include: blocked generation, warnings, manual review, or account restrictions.
Consequences of Violations
Violations of this AUP may result in: (a) immediate removal of the offending content; (b) warnings or limited account functionality; (c) permanent account suspension without refund; (d) reporting to relevant law enforcement when illegal content is involved.
Reporting Violations
If you find any content on the platform that violates this AUP, please report it immediately by email to: support@imagicshots.com
5. Termination
We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or the AUP.
6. Disclaimer
Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied.
